European Court Takes On Complaints By Azerbaijani Refugees

The European Court of Human Rights has declared admissible the case of Azerbaijani refugees "Chiraqov and others" against Armenia.

The Grand Chamber is to hear the case and will deliver its judgment at a later date.

The case concerns complaints from displaced Azerbaijanis (IDPs) who were forced to flee their homes in 1992.

The applicants - Fakhraddin Pashayev, Ramiz Jabrayilov, Saghatel Jabrayilov, Akif Hasanov, Adishirin Chiragov and Elkhan Chiragov - complain in particular about their loss of property in Lachin, as well as various other possessions. The applicants rely on Article 1 of Protocol No 1 (protection of property) and Articles 8 (right to respect to private and family life) and 13 (right to an effective remedy) of the European Convention on Human Rights.

Finally the applicants claim, under Article 14 (prohibition of discrimination) of the Convention in conjunction with all the above articles, that, if they had been ethnic Armenian and Christian, they would not have been forcibly displaced from their homes by Armenian forces and that their property rights would have been recognized and their complaints investigated.

The application was lodged with the European Court of Human Rights on 6 April 2005.

The European Court of Human Rights Grand Chamber also declared admissible the issue of Minas Sargsyan against Azerbaijan.
